1. OVERVIEW

This website is operated by ProtoClinical. Throughout the site, the terms “we”, “us” and “our” refer to ProtoClinical. By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions.

2. HEALTH & MEDICAL DISCLAIMER (CRITICAL)

By purchasing from this site, you acknowledge and agree to the following:

  • Cosmetic Products: Skincare items are intended solely for cleansing, beautifying, or altering the appearance. They are NOT medical treatments for skin diseases (e.g., cystic acne, eczema).

  • Dietary Supplements & Food: * These products are NOT intended to diagnose, treat, cure, or prevent any disease.

    • Statements regarding dietary supplements have not been evaluated by the FDA, EFSA, or any other local health authority.

    • Supplements should not be used as a substitute for a varied diet and healthy lifestyle.

  • Consultation: Always consult with a physician or healthcare professional before using a new skincare product or starting any dietary supplement, especially if you are pregnant, nursing, or have a pre-existing medical condition.

  • Allergies & Sensitivities: Ingredients are listed on product pages. We sell products containing extracts from nuts, soy, seafood, and other potential allergens. It is your responsibility to review ingredients. We are not liable for individual allergic reactions. Conduct a patch test for cosmetics and consume a small amount of food items to test tolerance.

3. INTERNATIONAL IMPORTATION & COMPLIANCE

  • Importer of Record: You are the "Importer of Record." You are responsible for ensuring that the products (especially supplements and food items) can be lawfully imported into your country.

  • Local Regulations: Some countries have strict bans on specific supplement ingredients (e.g., high-dose vitamins, specific herbal extracts). ProtoClinical is not responsible for items seized, destroyed, or returned by customs due to local ingredient restrictions.

  • DDP vs. DDU: * Orders to USA and EU (Standard Shipping) are generally DDP (Delivery Duty Paid).

    • Orders to Canada, UK, and other regions are DDU (Delivery Duty Unpaid). You are responsible for all local taxes and customs fees.

4. PRODUCTS AND ACCURACY

  • Korealy Sourcing: Our products are authentic and sourced directly from South Korea via Korealy logistics.

  • Packaging Variations: Manufacturers frequently update packaging. The product you receive may have slight visual variations from the website images, but the core formula/content remains as described.

  • Shelf Life: We guarantee that all food and supplement items are shipped with a reasonable remaining shelf life. Once delivered, proper storage (cool, dry place) is the customer's responsibility.

5. LIMITATION OF LIABILITY

To the maximum extent permitted by law, ProtoClinical, our directors, or employees shall not be liable for any injury, loss, or claim arising from:

  1. Misuse of products.

  2. Failure to consult a doctor before use.

  3. Allergic reactions to known or unknown ingredients.

  4. Customs seizures or delays.

In jurisdictions that do not allow the exclusion of liability, our liability shall be limited to the maximum extent permitted by law (typically the value of the order).

6. GOVERNING LAW

These Terms of Service and any separate agreements shall be governed by and construed in accordance with the laws of Brazil. Any disputes will be resolved in the jurisdiction of the courts of Brazil, without prejudice to your mandatory consumer rights in your country of residence (such as the UK Consumer Rights Act or EU consumer protections).
